Summary

State constitution
The constitution of Idaho is roughly modeled on the national constitution, with several additions. The constitution defines the form and functions of the state government, and may be amended through plebiscite. The state constitution presently requires the state government to maintain a balanced budget.

Idaho Code and Statutes
All of Idaho’s state laws are contained in the Idaho Code and Statutes. The code is amended through the legislature with the approval of the governor. Idaho still operates under its original (1889) state constitution.

The constitution of Idaho provides for three branches of government: the executive, legislative and judicial branches. Idaho has a bicameral legislature, elected from 35 legislative districts, each represented by one senator and two representatives.

Since 1946, statewide elected constitutional officers have been elected to four-year terms. They include: Governor, Lieutenant Governor, Secretary of State, Idaho state controller (Auditor before 1994), Treasurer, Attorney General, and Superintendent of Public Instruction.

Last contested in 1966, Inspector of Mines was an originally elected constitutional office. Afterward it was an appointed position and ultimately done away with entirely in 1974.

A Republican, he was the U.S. Representative for Idaho’s 2nd congressional district from 1993 to 1999

James Elroy Risch (/ˈrɪʃ/ RISH; born May 3, 1943) is an American lawyer and politician who has served as the junior United States Senator from Idaho since 2009. A member of the Republican Party, he served as lieutenant governor of Idaho from 2003 to 2006 and from 2007 to 2009, and as governor of Idaho from 2006 to 2007.

Prior to his career in politics, Risch was a prosecuting attorney and taught criminal law at Boise State University.

Russell Mark Fulcher (born March 9, 1962) is an American businessman and politician serving as the U.S. Representative for Idaho’s 1st congressional district since 2019. A member of the Republican Party, he previously served in the Idaho Senate where he represented Legislative District 21 from 2005 to 2012 and Legislative District 22 from 2012 until 2014.

Fulcher ran for the position of Governor of Idaho in 2014 but narrowly lost the nomination to incumbent Butch Otter. He was elected to the U.S. House of Representatives in 2018 after a divorce scandal and succeeded incumbent Raúl Labrador, who retired from Congress to run, unsuccessfully, for Governor of Idaho.

Michael Keith Simpson (born September 8, 1950) is an American politician serving as the U.S. Representative for Idaho’s 2nd congressional district since 1999. A member of the Republican Party, he was first elected in the 1998 elections, succeeding Mike Crapo.

Simpson previously served as an Idaho State Representative (1984–1998) and was Speaker of the Idaho House of Representatives from 1992 to 1998.
